Willows Swim Club – Waiver and Liability Agreement

I, the parent or legal guardian, on behalf of myself and all individuals (adults and minors) identified on my membership account and/or on this form, understand that participation in swimming, diving, and other recreational activities at Willows Swim Club involves certain natural risks. These include, but are not limited to, slips, trips, physical injuries, health-related incidents, or other unexpected outcomes. I recognize that these risks may result from individual actions, the behavior of others, equipment use, or environmental conditions, and I willingly accept personal responsibility for any such events that may occur.
I agree, on behalf of myself and those I am responsible for, to follow all posted rules and safety guidelines established by Willows Swim Club and to comply with the directions of club staff. I understand that the club reserves the right to limit access to its facilities and equipment if safety or rule compliance becomes a concern.
In consideration for being granted access to the club and its amenities, I hereby release and hold harmless Willows Swim Club, along with its board members, officers, employees, agents, and representatives, from any and all claims, demands, or liabilities that may arise from the use of the club’s pools, diving boards, playgrounds, sports courts, grilling area, and any other part of the club grounds—regardless of whether those claims arise from my own actions or the ordinary negligence of the club or its representatives.
To the extent permitted by law, this release also applies to ordinary negligence on the part of Willows Swim Club, its staff, and agents. I understand that this waiver is intended to be interpreted broadly in favor of protecting the Club from liability in connection with access and participation.
Additionally, I agree to be financially responsible for any damage to the club’s facilities or equipment caused by my own actions or those of my family members or guests, including through misuse, disregard for safety guidance, or lack of supervision.
Should an emergency occur, I authorize Willows Swim Club personnel to arrange appropriate medical assistance for anyone listed on this form. I understand that I am responsible for all associated costs related to any emergency services or treatment provided.
I acknowledge that Willows Swim Club, its representatives, and staff may deny access to certain areas or activities at their discretion in accordance with club policies. I further understand that this agreement is governed by the laws of the State of New Jersey and replaces any prior verbal or written agreements regarding liability and facility use.
By signing below, I confirm that I have read and understood this agreement and that I accept its terms voluntarily and without reservation on behalf of myself and all individuals listed on this form.
